For applicable event bookings the following Terms of Business will apply:
Welcome to Event Photos (eventphotos.co.uk). We are pleased that you have chosen us to provide professional photography at your event. This document sets out our terms of business. We will also provide you with a Contract, known as the Engagement Letter, which summarises these terms and includes the specific terms we have agreed and any other matters of interest requested by either side. The Engagement Letter is signed by both parties and takes precedence over these terms.
1. Contracting Parties
You agree that these terms apply to your matters, except to the extent that we inform you in writing that different terms apply. The Engagement Letter takes precedence over these terms. We will not be responsible for excluded matters or matters not included in the Engagement Letter.
2. Fees, Charges, Commissions
Any fees, charges or commissions will be outlined in the the Engagement Letter. Costs and expenses, if applicable, will also be addressed in the Engagement Letter as will terms of payment.
3. Insurance & Liability
We hold current Public Liability Insurance. Where we appoint another party by sub-contract, they are also required to hold such insurance. Where we, or any sub-contractor we appoint, act for you, no individual will have any liability to you. You shall not bring any claim against us or individuals for breach of duty or otherwise.
4. Copyright
Copyright and all intellectual property rights related to images taken by us remain with us. We operate a sensible policy on copyright, understanding that images will be used by clients and customers for multiple purposes and across platforms. Such personal uses, including home printing from hi-res digital files supplied by us, are within the terms of our licence. Copyright claims only arise if customers or clients attempt to profit from our copyrighted images. Where images are required for use by the client for PR or other purposes, prior consent is required from us.
5. Data Protection
Data Protection Policy
We are strongly committed to preserving the privacy of its customers. This Data Protection & Security Policy outlines our policy for the collection and use of information about customers and their transactions with us.
Summary
We don’t share personal information with other companies without your prior explicit permission in writing.
We only use emails provided to us at sign-in to contact you about notices referring to your gallery or our services (e.g. gallery closing notice). Customers are given the opportunity to opt-out of future emails.
Personal Information
If you register to use our websites, we will ask you to provide us with certain up to date data about yourself which we will handle in accordance with the United Kingdom’s Data Protection legislation. We maintain strict security standards and procedures with a view to preventing unauthorised access to your data by anyone, including our staff. We use leading technologies such as (but not limited to) data encryption, fire walls and server authentication to protect the security of your data. Event Photos staff, including photographers or other third parties we hire to provide support services are required to observe our privacy standards.
Placing Orders
When ordering items online, our order form asks you to give us information specific to that order, including your billing address, shipping address, and email address. The information you provide is used to process and send your orders and/or to contact you if there is a problem with the order. We do not share our customer list with any third parties, and never make it available to other companies.
Cookies
Cookies are pieces of information that a website transfers to your computer’s hard disc for record keeping purposes. Cookies can make the web more useful by storing information about your preferences on particular sites, thus enabling website owners to provide more useful features for their users. They contain no name or address information or any information that will enable anyone to contact you via telephone, e-mail or any other means. Most browsers are initially set to accept cookies. If you would prefer, you can set your browser to disable cookies or inform you when they are set. However, given that we may sometimes use cookies you may not be able to take full advantage of our website if you do disable them.
Information at checkout
Event Photos uses standard industry security practices to protect your personal information including SSL transmission technology for all sensitive information exchanges. This technology encypts information you submit to avoid it being intercepted before reaching either Zenfolio’s or PayPal’s secure HTTPS servers, the two payment gateways we use. Any sensitive billing information (e.credit card information) is then stored in an encrypted format so that no party has access to it.
Addendum
Any other matters relating to Data Protection not addressed above that the client wishes to have addressed can be included in the Engagement Letter.
6. Invoices and Payment
Terms of payment will be outlined in the Engagement Letter.
7. Changes
We reserve the right to change or add to these Terms of Business, either generally or for a particular Engagement, by notice in writing.
